Terms of Service

Acceptance of terms
By using Fidem ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
These terms apply to landlords, property managers, and other operators who use Fidem to organize rental application document verification workflows.
What Fidem provides
Fidem provides a document verification workflow platform. The Service extracts fields from submitted rental application documents (pay stubs and bank statements), runs deterministic verification checks, and produces structured verification reports.
Verification reports describe signals extracted from submitted documents. They are provided to assist landlords and property managers in organizing their review of submitted rental application materials.
What Fidem does not provide
Important limitations of the Service
- Fidem does not provide credit reports, credit scores, or credit history.
- Fidem does not provide background check reports of any kind.
- Fidem does not provide eviction records or rental history.
- Fidem does not produce tenancy recommendations or eligibility determinations.
- Fidem is not a Consumer Reporting Agency under the Fair Credit Reporting Act (FCRA) or similar legislation. Fidem reports must not be used as consumer reports.
All tenancy decisions are made solely by the landlord or property manager. Fidem bears no responsibility for tenancy decisions made on the basis of, or in connection with, the use of the Service.
User responsibilities
By using the Service, you agree to:
- Use the Service only for lawful purposes in connection with rental application review.
- Obtain appropriate consent from rental applicants before uploading their submitted documents to the Service, in accordance with applicable law.
- Not use verification results as the sole basis for tenancy decisions without applying your own independent judgment.
- Not represent Fidem verification results as credit reports, background checks, or official verification records.
- Not upload documents belonging to individuals who have not submitted those documents as part of a rental application.
- Maintain the security of your account credentials.
Landlord decisions are final
Fidem surfaces verification signals from submitted documents. It does not make tenancy decisions, produce eligibility determinations, or recommend that any particular tenancy decision be made.
The landlord or property manager bears full responsibility for all tenancy decisions. Fidem is not liable for tenancy decisions made in connection with the use of this Service, regardless of the content of any verification report.
Acceptable use
You may not use the Service to:
- Process documents without the knowledge of the individuals whose documents are being submitted.
- Represent the Service as a background check, screening, or credit reporting product.
- Circumvent, disable, or interfere with security features of the Service.
- Share your account credentials with unauthorized parties.
- Use the Service in violation of applicable housing laws, fair housing regulations, or privacy law.
Account and access
You are responsible for maintaining the security of your account and for all activity that occurs under your account. Notify us immediately at legal@usefidem.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.
Service availability
Fidem is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability of the Service. We are not liable for losses caused by temporary unavailability, processing delays, or Service errors.
We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
Limitation of liability
To the maximum extent permitted by applicable law, Fidem and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Service.
Fidem's total liability for any claim arising from the use of the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
Changes to these terms
We may update these Terms of Service as the Service evolves. Material changes will be communicated to users. Continued use of the Service after an update constitutes acceptance of the revised terms.
